    PRACTICE AREAS

    REAL ESTATE:

    RESIDENTIAL REAL ESTATE TRANSFERS

    For the seller, we examine the contract, advise on any changes necessary, order the title insurance, survey and pest report.  We prepare the deed and other closing documents and attend the closing with the seller.  We perform any post-closing followup necessary.

    For the buyer, we prepare or examine the contract, advise on any changes necessary, and follow up with real estate agents and mortgage lenders.  We attend the closing with the buyer and explain the documents to be signed.  We perform any post-closing followup necessary.

    MATTERS RELATED TO REAL ESTATE

    We can file actions to partition real estate, to quiet title, or to determine the rights of interested parties regarding encroachments, easements, or boundary disputes.

    We can file petitions with local zoning boards to obtain variances.

    We can appear at condominium board meetings on behalf of unit owners with grievances.

    For landlords, we can file actions to evict delinquent tenants.

    WILLS AND PROBATE MATTERS:

    PREPARATION OF WILLS AND RELATED DOCUMENTS

    We draft wills and assist clients in getting them properly executed.  We also prepare “living wills” with specific requests for end-of-life treatment.  We prepare the Power of Attorney for Health Care that allows someone to take charge of the client’s medical care when the client is unable.  If requested, we prepare a Disposition of Remains designation.

    PROBATE OF WILLS

    When a person dies, we help the family to settle the estate by filing the required case in Probate Court, whether the deceased person left a will or died without one.  In some cases a Small Estate Administration is all that is required.  We assist the executor of the estate in completing and filing the necessary paperwork.

    GUARDIANSHIP CASES

    If a child requires guardianship for any reason, we help the guardian to file the necessary paperwork and thereby obtain legal guardianship.  We explain the duties and obligations 
    of guardianship to the person serving as guardian.

    We also handle guardianship cases for disabled adults at any stage from filing to closing out the case.

    BANKRUPTCY AND DEBT RELIEF:

    BANKRUPTCY CASE PREPARATION AND FILING

    Of the types of relief available, Chapter 7 is better for the person with few assets, low income, and debts that are mostly unsecured by collateral.  We prepare and file your petition with the Bankruptcy Court, attend your meeting with the Trustee, and assist you in completing all of the other paperwork.

    For the person with a steady income and a home or other property to protect, Chapter 13 is better.  Stop mortgage foreclosures and repossessions!  In three to five years, you can be debt-free.  We prepare the petition and plan and assist you in gathering and submitting the other paperwork.  We attend your meeting with the Trustee and defend you in court when creditors move to take your property.

    DEBT NEGOTIATION

    For a person who wants to avoid bankruptcy and has cash available, but not enough to pay off all debts, we can negotiate with creditors to settle outstanding debts.  Creditors may be willing to settle for 50% or less of outstanding debts if you have immediate funds available to send after an agreement is reached.
